On Flexible New Deal if you should receive a letter of notification from your Flexible New Deal provider stating that they have refered you to a decision maker for a Flexible New Deal sanction for whatever reason they should enclose the following guidance called ESL48JP.

So, Flexible New Deal providers can give you a fixed sanction… actually they can give variable sanctions too. There is some confusion as to the extent of their powers. I have been tipped off by a blog viewer about the issue with a Decision Maker trying to apply a sanction for failing to apply for a job given to her as a Jobseeker Direction which is clearly “unreasonable”.
