    1630 I returned the call to tony hickman. Tong hickman stated that their was no meechanism for me to change providers the only recourse would be for them to send me to a 3rd party subcontactor. Like pertemps. ICE can be contacted by normal people but was told that there is a health and parliamentary ombudsman that could take on my complaint and investigate this called anne abrahams but you need to be refered by your mp and as there is a election coming up it could be quite a time I am therefore stuck with A4E

      this is a thorny subject,and this is why the whole treatment of unemployed people by the government suggests some dangerous overtones towards a section of society that are subjected to continued mistreatment and a form of persecution.

    Yes FND your right there. I am trying all actions. I was told yesterday that there is no mechanism to move me to a different provider. I have to therefore stay there and get kicked at when they feelthe need to have a god at someone. I tld the dss managr about their threat of a sanction for not going to see if could be a teacher bearing in mind i have no teaching diploma, or teaching assistant qualifications whatsoever.

    I am therefore at the mrcy of vexatious sanctions.

    Andrea Harris is the woman who found that personthe job and was celebrating the fact. their is an article on this somewhere on thi site.

    • There is a mechanism for transfer. It even existed on New Deal (different provision types not provider).

      Also there is no law laying down Flexible New Deal in regards to providers. In my area there are two providers (plus subcontractors) and people are randomly assigned. There is no reason why they can’t take you to another provider and send an additional person over to A4e to make up the numbers. People don’t start Flexible New Deal by tax year etc. but by the time into their claim and you can claim for pretty mcuh any week of the year so it will be different for everyone. This makes it easier to transfer people.

        • Its probably true. There is likely no law stating about transfers… (I will do some research and get back to you).

          It is TRUE however that there is NO law stating that DWP… CANT change someones provider before or during Flexible New Deal.

          No law FOR it or AGAINST it.

          All it is INTERNAL POLICY… assign a random provider… to get the providers an rather fair (not human selection) share of long-term unemployed persons (i.e. some maybe never worked, some ex-”professional”, some have big barriers etc.) they randomly select people (not sure how.. maybe by referral date , NI number (maybe last digit), letter of your surname or on a push-pull pool system (50 to one provider, next 500 to the next… on rotation). Either they dont want the extra paperwork OR there is no plans in place for a transfer i.e. no document explaining the process – absence of document doesn’t mean it can’t happen.

    23rd February. I have asked for a receipt for the teachers job application and this is in the process of being sent.back to meto help avoid the sanction. You see people im not a teacher and I have no qualification to be a teacher. If A4E had read the person specification they would of understood the fact thatit states that the essential qualification is teaching. A complete no brainer eh.

    I also telephonesd the chief executives office in london. They seem to think well they areunder the impression i don’t wish to co-oprate. That is wrong. I wantthe paperwork I have been promised and still awaiting. They state that I have been put in touch with the beacon centre for the blind. But as of yet have been unwilling to put this down in writing for me.

    Tina feakes of dwp halesowen complete centre manager states that their is not much of anything they can do.

    • Are you saying you have been sanctioned or in the process of being sanctioned for failing or refuse to apply for a job when:

      a) you have

      and

      b) you do not meet the essential criteria ?

      DWP’s executive agency Jobcentre Plus are the people who sanction you so thats absolute nonsense. Also, not receiving a response is very common these days, I am frustrated with email applications (an autoresponder is all what it takes… “thank you for… we have received your email”) with no reply. However, I obviously have the email in the Sent Item folder as evidence. When you post off a postal application unless you typed it on your pc or photocopied it you have absolutely no evidence you have sent it.

      Under the law you have to provide evidence that you are seeking employment. Nothing states about having a receipt or evidence of applying for jobs (be it a letter sent back to you or copy of the application) although this obviously helps to defend sanctions against you for this purpose. Actually, technically you dont have to apply for any job in particular apart from those submitted to you in the form of a Jobseekers Direction. FND providers now coming under that.

      It seems A4e are up to their old tricks again!!

        No new deal I was threatened with a sanction and she said “I have ground to pick up the phone and raise a doubt But i don’t want to do that as I have loads of paperwork to doas well”

        This person Should of read the person specification. Her manager later come over and I told her I didn’t like to be threatend like this. No it is not a threat this is what could happen. How can i expected to apply for and get a job teachingwhen I haven’t got a teaching qualification. If the person had read the person spec she should of understood this and discounted it. In my years at Action for Blind people they have never tried to send me for a job i cannot do. They have used extreme measure in so far that they have also checked my application, my personal statement and have been willing to escort me to an interview. The charity I have always gone to GREAT PEOPLE.

        A4E Refuses to send me the paperwork they should of sent me at the start. lets take a look at the sums requested on 14th January, requested by dwp 18th January. 23rd January the manger from A4E stated I shouldn’t of Been sent any paper.

        They also stated to the dwp that they put me in contact with Beacon centre for the blind. A brief phone call about a month ago. Nothing mentioned since then. I stated that I would go there when mandated but there is a question of Travel. We can Pay your Bus but no mention of anything else as I am incapable of using buses. As my records state and the number of places I have had to ring friends and family to ome and pick me up from as I have got on the wrong bus and eventhough I have requested a ticket to a certain place I have been issued an erroneous one. So how will i get to Beacon I don’t know

        A4E also stated to me yesterday that they do not need to write to me or provide me with paperwork. This is despite the,m stating that the papers I requested on 14th Are still on order. No mention or intention of them offering to photocopy enlarge the papers. But the fact that they don’t have to put anything in writing is scary.

        I have asked for grievance proceedures and the manager didn’t give me the next one up in the food chain. She stated that I have to write her a letter first stating my grievances and then she would reply and then send me her managers name.

        I also stated to the DUDLEY Manager that I have no confidence in Andrea Harrison and would I like to be moved to another personal carreer coach or PCC as they say and she said no I won’t.

        She then stated were going round and round in circles and nothing is getting done and WE don’tknow what we are going to do. Welll they could send me back to the dss stating I should be left to continue with action for the blind people or they could contact them themselves and A4E has done nothing.

        I stated that I intend to come in and speakto them when requested to do so. And I said I would hand in My CV under protest as they had demanded it. She said no one has demanded your cv. You control your cv, and we are crb checked and all that gumpf we can be trusted. THEY CAN’T be trusted to Produce paperwork for myself, A mandated letter stating that they think I should goto beacon, And they have also lied to the dwp as a letter I have received would prove this.

    the government with these courses are “all fur coat and no draws” saying everything and delivering little except huge expence to the taxpayer.

    its little surprise these “cowboy outfits” are very keen to defect attention from themselves by outside scrutiny.

    if this is the case how prepared are the staff to to cope with the needs of the disabled,it would appear that they are not, and those effected would be well advised to seek the help of the disability rights commission with this blatant disregard in both course preparation and attitude of this company to prospective clients.

    i somehow think that they care little about the individual other then to cause hardship through the great emphasis on the sanctions’ just to cease benefits and to falsely label individuals as idle trouble.

    At approximately 14:00 had a phone call from ms Smith of A4E dudley branch. Just to give me a heads up regarding the meeting on tuesday as someone from beacon will be there as well and we will be referring me to beacon. If I have any problems please werite them down and ask at the meeting. I will be receiving a letter from A4E stating their intentions.

    05/03/2010 Had a telphone call from CAB asking for more information and it isnow being refered to a specialist advisor.

    11:30 I received My FIRST ever letter from A4E in large print. I have been informed that ms Jobling of beacon centre will be atending this meeting. The first ever meeting I have ever had despite mr Dara singh of DWP sending me a letter that states I have been put in contact with beacon already. A ten minute phone call. I can hardly call that contact.

    16:00 I attended the MP Mrs S Heals Surgery in halesowen and spoke to her for roughly 30 Minutes. A pretty none commital meeting this time as the first ever meeting with beacon is on monday 9/03/2010. She did state she would get invloved after that. I also pointed out the failures in current legislation.

    1 The lack of discretion on any level as to whom is sent to the FND Providers.

    2 Neither Managers or DEA Can think well this is not suitable for this person so we wont. They are compelledto whereas under the New deal scheme they could.

    3 I have been working with action for Blind People for a number of years to get employment and have been successsful in the past and have worked wonders for me. I stated that I was already doing everything flexible new deal tries to do. increased job searches, cv checked and re-written, Interviews and Mock interviews, Confidence boosting excercises, all correspondence in large print, jobns that are actually suitable for me.

    I stated that A4E threatend me to apply for a teaching job and mrs heal wasn’t amused by that especially as it said I needed a teaching qualification. She did also say well your doing everything and youv’e been sent to A4E. You should be allowed to carry on going to ACTION and Not A4E.

    I felt good about myself for the first time in ages I have applied for a job off my own bat and not by A4E. I signed on and was talking to a lady called jo and telling her how useless A4E are being and she mentioned that they had sent in a comment about me not taking up a job offer with Beacon. THETEACHING JOB ?? She did fluff around a short time and mentioned this could be a sanctionable offence. I was taken back by this and stunned I said thats a damn lie. I then left the dwp halesowen and proceeeded to phone andrea of a4e andI had a hissy fit at her and I said A Lie is A Lie. At no time have I been offered a job and refused it. I said your taking the piss here and she went into the your swearing at me. And shortly she hung up. I went back over to the Job centre and spoke to manager tony Hickman. Pretty much the party line they did admit that they had made a cock up about the large print and a couple of other items. I stated I had been to MP S Heal about them and he told me what happens next. He stated that lessons are being learnt and have been learnt by the dwp and a4e. Well that made me feel better and he stated well don;t worry about what was on your file it has been over looked with a slight smile. During my meeting I had a phone call of A4E jenny smith and it said there had been a mistake this should never of happened and it will be sorted tomorrow.

    I had prepared my cv making sure that stuart williams name would be well and truly visible in my attempt to well and truly quash the chance of A4E copying the CV and claiming they had helped me with it.. When I presented the CV they told me it was no longer needed as I had been reffered ono Beacon for the blind. I met the lady called katie jobling , first impression nice lady. Time will tell but it seems that A4E had really wanted to get rid of me. No mention of the incorrect ifnormation held by the dwp. So I bought it up and she said don’t worry about it as they have obviosuly had an erroneous communication from a4e with the ongoing complaint. Andrea in my opinion was a bit cold mind you I did get a bit arsey with her.
